Governor Culver Provides Emergency Relief to Iowans from Escalating Fuel Prices and Disruptions in Delivery of Diesel and Gasoline.

Proclamation orders temporary suspension of hours of service regulations.

Governor Chet Culver today signed a proclamation that suspends the regulatory provisions of Section 321.449 of the Iowa Code pertaining to the hours of service for motor carriers and drivers of commercial motor vehicles while transporting diesel fuel or gasoline on Iowa roadways.

The temporary suspension of the hours of service regulations is intended to provide relief to Iowans suffering from increased fuel prices, and to farmers and other consumers of diesel fuel that are experiencing significant disruptions in the delivery of diesel fuel, which is necessary to complete the harvest, transport goods to storage and processing facilities, and meet other shipping and transportation needs.

“Disruptions of pipeline supplies to Midwest refiners, scheduled maintenance activities and peak demand for diesel fuel due to the early harvest have created a serious fuel supply problem for Midwest states,” Culver said. “Temporarily suspending the hours of service regulation will help ensure that farmers and others receive timely delivery of the fuel needed to meet their transportation needs.”

The proclamation directs the Iowa Department of Transportation to monitor the operation of this proclamation to assure the public’s safety, and to facilitate the movement of vehicles involved.

Details regarding the applicable conditions for which motor carriers and commercial vehicle operators can receive relief from the regulatory provisions are outlined in the proclamation.

The suspension is good for 60 days from Sept. 21, 2010, the date in which Governor Culver declared the entire state to be in a State of Disaster Emergency due to the significant size of the corn and soybean crops and weather concerns.
